April 23, 2023 Election Results
On April 23, 2023, despite repeated attempts by a rogue Board to confuse and dissuade unit owners from attending, a duly called Special Meeting was brought to order at 5:00 PM at the Henson Valley Christian Church at 1900 Tucker Road in Fort Washington, MD. There were over 50 people physically present, plus 142 unit owners represented by proxy.
At least four years had passed since the last Annual (or Special) Meeting of the unit owners of Brookside. At lease four years had passed since the unit owners of Brookside were given an opportunity to elect their representatives on the Board. Multiple excused were given as to why elections should be postponed. These included the COVID-19 pandemic; the fact that Brookside’s Managing Agent had been fired; that ballots (issued by the Board) were imperfect; that Brookside was in litigation with Rogal Management; or, as in April 2023, for no stated reason at all. furthermore, no budget was issued for either 2022 or 2023; and no financial report of any kind has been produced by this Board to account for the finances of the Association.
This all changed on April 23, 2023. After the meeting was called to order, and quorum was met (25% of eligible votes were required to meet quorum; we had 37% in attendance in person or by proxy). The first order of business was to ratify the removal of the entire Board, pursuant to a Section V; Article 6 petition drive. 197 petitions, well over the required 35% threshold, had been presented to the Board last October. They languished, dubbed “fake” by the ousted Board President, or “moot” by George Perry, Esq., one of the Association Counsels and Resident Agent (moot because, as Mr. Perry stated, we would have a new Board by the October 30, 2022 election, thus rendering the petition drive moot.) Of course, on October 29, 2022, the election was cancelled. The motion to ratify the removal of the Board passed unanimously.
The second order of business was to conduct the election. After all candidates to the Board who were present had a chance to address the unit owners and share their vision, the election was conducted peacefully. The vote count was conducted by unit owners not running for office, under the supervision of two Officers of the Court.

Over the next few weeks, the Board will convene a meeting in Open Session, welcoming input and participation from all unit owners. In the near term, the Board will work diligently to 1) Effect as smooth a transition as possible considering the circumstances; 2) Gain an understanding on the finances of the Association, (despite the dearth of information that has been shared with us over the past few years) so as to report back to the unit owners on the health of our financial position; 3) Ensure that critical positions are staffed (e.g. Property Management; security; janitorial; trash removal; grounds keeping; towing; etc.) so as to avoid lapses in services to unit owners and residents.
