Unit Owners for Change Response to the Board and to the Office of the Attorney General
Many, but probably not all, of you by now have received notification from the "Board" stating that the election was to be postponed once again.
By our count, this will be the sixth time an election date is passed without actually holding an election under the leadership of this Board.
And now, the latest election date (yet to be confirmed) is November 15, 2022.
We put "Board" in quotes because not only are the members' terms long over, but sufficient valid petitions for resignation and a special meeting have been submitted to terminate their position. This group is acting without proper authority.
We should be clear about the facts:
We, the Unit Owners, clamoring for an election for almost four years, have not determined the election process. In fact we are frozen out.
Once it became clear that the vast majority of the members had serious concerns about the current Board, a new lawyer was hired by it to come up with a rationale for another election delay.
In the meantime, we have no protection for the Association's business - including your money - while the current regime stays in place.
We were concerned about this exact scenario--namely that after the vote is cast, someone would decide to change the rules because they don't like the results. Therefore, we explicitly requested confirmation in advance of the election about a number of issues pertaining to election transparency, independent oversight, and voter and candidate eligibility. We received assurances on these issues that have been violated. In fact, the lawyer who made those assurances for Mr. Lucas and his group has now been replaced by a new lawyer.
We were on our way to having a successful election - with more member participation than has been seen in years.
Now, after three and a half years of delays, and as we near the election date supported by the Office of the Attorney General, this Board claims, yet again, that the election must be delayed "per Counsel's advice".
Were there Board deliberations about all this? Was a vote taken to pursue this course of action? Are there minutes documenting these deliberations and the decision to expend more Association funds to hire another Counsel in order to contest/delay the election? Why are these decisions never shared with us, the owners of Brookside Park?
Most importantly, why is the current group clinging so tightly to their roles?
